INFORMATION ON THE GENERAL DATA PROTECTION REGULATION

Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), referred hereunder as ‘the GDPR’, came into force on 25 May 2018. The purpose of the GDPR is to harmonise data privacy laws throughout the European Union. What follows here is information on the processing of your personal data by GLASSPROF Sp. z o.o., having its registered office in Ogrodzona, and the rules we have applied for processing them since 25 May 2018.

WHO WILL BE PROCESSING YOUR PERSONAL DATA?

Pursuant to Article 4, item 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as the GDPR, the controller of your personal data is GLASSPROF Sp. z o.o., ul. WHY DO WE PROCESS YOUR PERSONAL DATA?

We process your personal data in accordance with the strict minimum required for the purpose of the processing and on the basis of specific laws (lex specialis) and the GDPR. Irrespective of the foregoing:
1. You have the right to be informed as to both the purpose for which your data is being processed and the legal basis for doing so. GLASSPROF processes your data for the purposes set out below, as applicable:

  • employment, including recruitment processes;
  • working with contractors;
  • CCTV monitoring and security
  • handling claims and insurance
  • correspondence
  • the GLASSPROF website


2. You have the right to request GLASSPROF to give you access to your data, to rectify them, erase them, in some instances, and to limit their processing, the right to object to their processing, the right to transmit them, the right to data portability, in some instances, and the right to obtain copies of your data;
3. If your personal data are being processed on the basis of Article 6 item 1 (a) or Article 9 item 2 (a) of the GDPR, you have the right to withdraw your consent to their processing at any time without affecting the lawfulness of processing carried out on the basis of your consent before its withdrawal. Instances of this kind will be clearly marked as the processing of data on the basis of the data subject’s consent.
4. If your data is being processed on the basis of Article 6 item 1 (f) of the GDPR, which is to say, for the purposes of legitimate interests pursued by GLASSPROF, you have the right, at any time, for reasons connected with your specific situation, to object to your personal data being processed on that basis;
5. You have the right not to be profiled within the meaning of Article 22 of the GDPR. GLASSPROF declares that under no circumstances does it profile natural persons;
6. The right to file a complaint with the President of the Office for Personal Data Protection (www.uodo.gov.pl/en);

RECRUITMENT


Should you wish to apply for a position at GLASSPROF, your data will be used for the purposes of carrying out the recruitment process.
We collect three main types of data for recruitment purposes, namely, your contact details, details about your career and previous employment and data about your qualifications/skills.
We process those data on the basis of the provisions of the Act of 26 June 1974, the Labour Code, in particular Article 22(1). The data you provide for recruitment purposes are provided voluntarily. However, they essential to the verification of job applicants. Failure to provide them will render it impossible for you to participate in the recruitment process in question. GLASSPROF does not use data from recruitment processes for any other purpose.
We will process your data until a candidate has been selected for the post and for the subsequent six months.
If you would like to permit us to use your CV for future GLASSPROF recruitment purposes, please add the following consent to it:
Pursuant to Article 6 item 1 (a) of the GDPR, I consent voluntarily to the use of the data from the CV I am submitting for the purposes of future recruitment carried out by GLASSPROF Sp. z o.o. until such time as this consent is withdrawn.

PLEASE NOTE!

You have the right to withdraw your consent at any time, which will not affect the lawfulness of processing based on the consent before its withdrawal. Your personal data will be processed until the consent is withdrawn.

Only authorised GLASSPROF staff members/collaborators have access to your data. In particular, they are:

  • the staff members of the external entity responsible for personnel matters;
  • the Company’s Board of Directors;
  • the head of the department you are apply to;
  • the external companies servicing GLASSPROF’s online platforms.

and, in justified instances:

  • the external entities associated with legal and IT services for GLASSPROF;
  • the entities with access to data collected in connection with the security of GLASSPROF facilities, which is to say, external security service providers.

If we have obtained your data from another entity/person or from publicly available sources, you will also be informed of this fact and of:

  • the extent of the data obtained;
  • the specific source of the data.

The situation described in the foregoing could occur, for example, when your data are transferred to us by:

  • your friends/family
  • current members of our staff

The legal basis for these operations is Article 6 item 1 (f) of the GDPR, in other words, legitimate interests pursued by the GLASSPROF or your consent.

CONTRACTORS

Contractors’/potential contractors’ data are processed pursuant to Article 6 1 (b) of the GDPR; in other words, the data processing is necessary for the execution of a contract to which the Contractor/potential contractor is a party or in order to take steps which are necessary prior to entering into it.
The provision of the data is voluntary; however, not providing them will render the conclusion of the contract and/or conducting business discussions impossible.
A contractor’s/potential contractor’s data are disclosed solely to GLASSPROF’s staff members, external companies providing services for GLASSPROF’s online platforms and accountancy operations and, where justified, to external entities involved in providing GLASSPROF with legal and IT services or performing contracts, such as freight forwarding companies, for example. 
The data will be stored for the duration of the contract and after its completion for the period stipulated by the applicable law or, when no contract is entered into, for up to three years following the conclusion of the talks.

If we have obtained your data from another entity/person or from publicly available sources, you will also be informed of this fact and of:

  • the extent of the data obtained;
  • the specific source of the data.

The situation described in the foregoing could occur, for example, when your data are transferred to the Company by our clients, particularly if:

  • they are your guarantors;
  • they are your legal representatives;
  • they are a party to a complaints process;
  • they are from a staff member’s/contractor’s family;
  • you are in the databases of companies creating databases of that kind.

Where the legal basis for these actions is GLASSPROF’s pursuit of its legitimate interests, as per Article 6 item 1 (f) of the GDPR, you may, at any time, for reasons connected with your specific situation, object to the processing of your data on that basis.

CCTV MONITORING

Where the legal basis for CCTV monitoring is GLASSPROF’s pursuit of its legitimate interests, as per Article 6 item 1 (f) of the GDPR, you may, at any time, for reasons connected with your specific situation, object to the processing of your data on that basis.
CCTV monitoring serves to ensure the security of people and property and as evidence. It is not transferred to anyone except entities authorised by law, such as the police, for example.
CCTV data is processed in Poland by an external company. The period of time for which it is processed depends on the quality of the recording and the medium used in the recorder, namely, the size of the memory. The maximum processing period is ninety days.
Entering the grounds of a GLASSPROF facility is voluntary; however, in order to use the Company’s services, it is essential. If you do not enter the areas covered by the CCTV monitoring, this may result in the non-performance of the subject of a contract or the non-initiation of pre-contractual operations.

COLLISIONS

For people involved in road traffic collisions and accidents involving GLASSPROF vehicles, the legal basis for processing data is the Act of 22 May 2003 on obligatory insurance, the Insurance Guarantee Fund and the Polish Motor Insurers’ Bureau and the Act of 23 April 1964, the Labour Code.
The recipients of personal data may be, for example, authorised institutions or authorities, within the scope of their statutory activities. They include the police, the courts, public prosecutors, city/town guards and entities with which GLASSPROF has concluded the relevant agreements.
Personal data will be processed for no longer than is necessary for the purposes for which it was collected, after which, the electronic and hard copies are deleted.

ENQUIRIES

Data from the GLASSPROF contact form or targeted correspondence such as product enquires/requests for quotes are processed solely for the purpose of responding to the enquiry/request/correspondence in question. The processing is carried out on the basis of Article 6 item 1 (f) of the GDPR, in other words, legitimate interests pursued by the controller or by a third party. You have the right to object, at any time, to your personal data being processed on this basis for reasons connected with your particular circumstances.
The provision of the data is voluntary; however, not providing them will render an exchange of information with GLASSPROF impossible. The data are disclosed solely to GLASSPROF’s staff members in the department to which an enquiry is addressed and, where applicable, to external entities connected with the provision of legal and IT services to GLASSPROF or the execution of the contract in question.
Enquires sent to the Company will be stored for the duration of our correspondence and for six years after it has finished.

THE GLASSPROF WEBSITE

The GLASSPORF website was designed allow people to visit it without the necessity of identifying themselves or revealing any of their personal data. By the same token, no data serving to identify visitors themselves or their computers is collected. The scope of the data which is collected is limited to the typical statistical information used in computer networks, such as the IP address, domain name, type of browser, type of operating system and screen resolution.

Use of cookies

Cookies are small text files originating from websites and stored by the Internet browser on the user’s end device. The information contained in a cookie can only be used by the website from which it was sent. On the Company’s website:

  • cookies are used solely for the purpose of improving the site’s useability;
  • disabling cookies means that you may not be able to use the solutions available on the site, including changing your settings;
  • cookies contain no personal data whatsoever;
  • users can disable the storage of cookies on their end devices at any time by changing the settings on their Internet browser.

The data collected via the contact form and during correspondence with GLASSPROF are used solely for the purpose of responding to the request/enquiry/complaint in question.

GLASSPROF reserves the right to change the information provided in this privacy policy by publishing a new version of it on this website.
